Immediate relatives and family preference categories

When applying for a green card through family sponsorship, the relationship between the petitioner and sponsor can affect the priority of the application. The US Citizenship and Immigration Services (USCIS) has two categories for family-based immigration: immediate relatives and family preference. Family members are classified into one of these categories.

Immediate relatives

Immediate family members receive priority in immigration processing as there are an unlimited number of visas allocated to this category. Those who are classified as immediate relatives are:

  • Spouse of a US citizen (IR1)
  • Unmarried child of a US citizen that is under 21 years old (IR2)
  • Orphan adopted abroad by a US citizen (IR3)
  • Orphan adopted in the US by a US citizen (IR4)
  • Parent of a US citizen that is at least 21 years old (IR5)

Family preference relatives

The family preference categories encompass all other eligible family members who seek to obtain a family-based green card. These individuals do not fall under the immediate relative category and as a result, the number of visas allocated to them is limited. This limitation often leads to a prolonged waiting period for those seeking a family preference green card.

  • Unmarried children of US citizens that are over the age of 21 (F1)
  • Spouses and unmarried children of permanent residents (green card holders) under age 21 (F2A)
  • Unmarried adult children of permanent residents (F2B)
  • Married children of US citizens of any age (F3)
