To qualify for the EB2 NIW visa, applicants must demonstrate that they meet the following requirements: 

  • Exceptional abilities or a substantial contribution: Applicants must demonstrate that they have exceptional abilities in a specific field, or have made a substantial contribution to science, art, business, or have a graduate degree.
  • National interest: Applicants must demonstrate that their presence in the United States would be of national interest.

     

Application Process For The EB2 NIW Visa

The application process for the EB2 NIW visa consists of two parts: 

  1. Form I-140 petition: The applicant must file an I-140 petition with the United States Citizenship and Immigration Services (USCIS).
  2. Form I-485: The applicant must file the Form I-485, Application to Register Permanent Residence or Adjust Status, with USCIS if they are in the United States or through a consular process for those outside of the United States.
